By accessing and using Sparkle AI, a product developed by Sevorse utilizing Nano Banana API, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our service.

2. Service Description

Sparkle AI is an AI-powered design generation platform that creates marketing visuals. The service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. User Responsibilities

• You are solely responsible for all content you create using Sparkle AI
• You must not use the service for any illegal or unauthorized purpose
• You must not violate any laws in your jurisdiction (including but not limited to copyright laws)
• You are responsible for ensuring your generated content does not infringe on any third-party rights
• You must not attempt to reverse engineer, decompile, or extract the source code of our service

4. Intellectual Property

User-Generated Content: You retain ownership of the designs you create using Sparkle AI. However, you grant us a non-exclusive, worldwide license to use, store, and display your content for the purpose of providing and improving our services.

Our Property: Sparkle AI, including its underlying technology powered by Nano Banana API, logos, trademarks, and all related intellectual property belong to Sevorse and our technology partners. You may not copy, modify, or distribute any part of our service without express written permission.

5. Copyright Compliance

Users are prohibited from:

• Generating content that infringes on copyrights, trademarks, or other intellectual property rights
• Creating content that mimics or copies existing copyrighted works
• Using our service to generate content containing unauthorized use of brand names, logos, or protected designs

Sparkle AI and Sevorse are not responsible for any copyright infringement committed by users. Users will indemnify and hold harmless Sparkle AI, Sevorse, and Nano Banana from any claims arising from copyright violations.

6. Prohibited Content

You may not create or generate content that is:

• Illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Hateful, racist, sexist, or discriminatory
Pornographic, sexually explicit, or obscene
• Violent or promoting violence
• Infringing on intellectual property rights of others
• Misleading, fraudulent, or deceptive

7. Account Terms

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account
• You are responsible for all activities that occur under your account
• We reserve the right to terminate accounts that violate these terms

8. Payment Terms

• All payments are processed through secure third-party payment gateways
• Credits are non-refundable unless otherwise stated in our Refund Policy
• Prices are subject to change with notice
• Unpaid invoices may result in account suspension

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Sparkle AI, Sevorse, and Nano Banana shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We are not responsible for any losses resulting from unauthorized access to your account
• We are not liable for any content created by users using our service
• Our total liability shall not exceed the amount you paid for the service in the last 12 months

10. Indemnification

You agree to indemnify and hold harmless Sparkle AI, Sevorse, Nano Banana, and their affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you create using our service

11. Termination

We reserve the right to terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
